Terms and conditions

This Regulation is applicable to users of the Ocular Prostheses Course that Francisco Llapart Castilla, with registered office at C/ Vilardell, 9, 08014, Barcelona (Barcelona), Spain, NIF.14600923V, offers students, without age limit or geographical location, for the development of formation activities, training and qualification, in the following modalities:

  • Virtual on-line: all the formative action (development of contents, activities, communication, interaction, evaluations) are carried out on the Moodle Virtual Platform.
  • Semi-presential: all the formative action (development of contents, activities, communication, interaction, evaluations) is developed on the Moodle Virtual Platform, complemented by optional or mandatory face-to-face sessions (tutoring, workshops, seminars, evaluations).

In all cases the attention is personalized, but no permanent Internet connection is required.

Interaction and participation may or may not take place in real time, depending on technical possibilities.

The main language used is international Spanish.
The areas of knowledge are the manufacture of ocular prostheses.

The registered user (Teacher or Student) acquires rights and assumes responsibilities that are defined in this Regulation of mandatory fulfillment.

GENERAL RULES (Terms and conditions)

1. Use of the Moodle Virtual Educational Platform

  1. The use of the Platform is subject to Legal Terms and Conditions, which must be read and accepted by the user in order to continue with the registration process. Also, there is a Code of Ethics and behaviour that must be respected by all users of the Virtual Platform.
  2. The user (Teacher or Student) commits to protect and not to transfer the keys assigned (or defined by the user) to access the Moodle Virtual Platform, and
    not to share them with third parties. In the event of non-compliance, the system will automatically detect inappropriate use and block access.

2. Technological requirements

  1. It is necessary to have basic computer knowledge at user level. It is convenient to have experience in online training in general, and Moodle Virtual Platform in particular.
  2. For a proper use of the teaching system (both for Students and Teachers) it is necessary to have the appropriate computer tools (hardware and software) for working on the Internet.
  3. It is necessary to have (or be able to access) an Internet connection (recommended ADSL) and computer tools (generally free download) of communication (or any browser) with permission to receive cookies (Internet Explorer 9.0 or higher, Google Chrome, Firefox) and Acrobat Reader 6.0® or higher.
  4. A personal (non-institutional or corporate) email account.

3. Registration in the system

Every user must proceed to personal registration in the system, creating a new account with password, following the instructions and completing the procedure of identity verification (by email to the address indicated) that the system performs automatically.

4. Method of teaching

The Student user accepts that the modality of teaching-learning using a Virtual environment (online) requires the following personal commitments for the best use of the system:

  1. Autonomy to organize themselves, define their personal goals and objectives, and determine systematic study plans and schedules, which allow for continued advancement of learning.
  2. Responsibility to take advantage of and use freely the educational resources that are made available, and to seek support in their personal learning process.
  3. Self-demand and motivation. It is the desire to learn and the effort to deepen the topics of study, so they must take advantage of the system as a true learning experience, with all the tools and information that is offered.
  4. Regarding the authority of the Teacher, for his times and for his plans for the follow-up and use of the formative activity. Consideration and respect for the academic contributions or opinions of others.
  5. A firm and continued desire to take advantage of the educational resource of education and training.

5. Methodology

The Virtual Platform uses Moodle (latest stable version), with its tools.

6. Communications

All communications between Teachers and Students will be channelled exclusively through the Platform’s own messaging system, automatically linked to the registered personal email.

7. Acceptance of the Regulation

The admission of the registered user to the Course of Ocular Prostheses supposes the reading and the acceptance of the present Regulation in all its terms and conditions.

8. Terms and conditions of use

Users using the Virtual Platform agree to:
a. Access only the Virtual Platform resources and tools for which they are granted permission.
b. Communicate to the Virtual Platform administrators any incident observed during the use of the Virtual Platform that violates the conditions of use.
c. Proceed with courtesy and respect towards the other users of the Virtual Platform, in any interaction with them and, in particular, in the discussion spaces.
d. Be responsible for ensuring that the material that is published complies with current legislation relating to it and, in particular, with the Law on Intellectual and Industrial Property.
e. Include in the personal file, on the Virtual Platform, a photographic image that allows to identify them.

9. Unacceptable use of the Virtual Platform services

Users of the Virtual Platform agree not to use the Virtual Platform, its infrastructure and services for:
a. Disseminating any material that violates national or international legislation in force on Intellectual or Industrial Property.
b. Disseminating information or material that may harm other users of the network (viruses, advertising mail, mail chains, spam mails, etc.).
c. Carrying out activities aimed at hindering the use of the network (congestion of links, denial of services, destruction of information, violation of privacy, etc.).
d. Publishing material that is or can be considered illegal, threatening, harmful, offensive, defamatory, obscene or pornographic.
e. Usurp the personality of another Virtual Campus user; simulate or falsify the user’s relationship with any other person or entity.
f. Disseminate information for any commercial, political, ideological or religious purpose.
g. Making unfounded or tendentious complaints about violations of rights of all kinds through the activities and content of the Virtual Platform.
h. Performing, in general, any act that violates Spanish law, morality or good customs.

10. Sanctions

Incorrect use of the Virtual Platform services will result in the temporary or permanent withdrawal of the use permit, depending on the severity of the incident and the degree of repetition of the user involved.
In any case, the University of Salamanca reserves the right to eliminate or withdraw, without prior notice and without any responsibility for it, a content or opinion when it appreciates that they incur in an unacceptable use of the services of the Virtual Platform.

11. Responsibility

The user states and declares that he/she assumes full and exclusive responsibility in the following cases:
a. When he/she violates the terms and conditions of use specified in this document.
b. When, by a third party, the Virtual Platform is subject to any type of claim, or judicial or extrajudicial injunction, related to the information or material that the user has published or sent through the Virtual Platform. Consequently, the user undertakes to hold the Virtual Platform harmless from any claim, obligation, loss, damage, prejudice, expense, violation, usurpation or infringement of intellectual or industrial property rights or any other type of right protected by Spanish law.

12. Liability Limitation

The Virtual Platform is not responsible, contractually or extra-contractually, for the consequences that the use of the Virtual Platform may bring to the user, such as actions of intruders (hackers), malicious software or damage to equipment, computers or properties, as well as for interruptions or failures in the operation of the Virtual Platform or its content or services.
The Virtual Platform is not responsible in any case for the opinions expressed by users through the various tools of the Virtual Platform, since they are not committed to, or in any way linked to, the opinions or policies of the Virtual Platform.
The Virtual Platform is not responsible for the consequences generated by visits to the pages and portals to which the links or hyperlinks contained in the Virtual Platform refer, given that the inclusion of the link or hyperlink does not imply that there is any
relationship between the operator of the page or portal to which it leads and the Virtual Platform.
In exercise of the obligations imposed by the Law of Services of the Information Society and Electronic Commerce, the Virtual Platform will collaborate with the relevant authorities, within the framework of the appropriate procedures, prior judicial request, for the identification of users who violate current regulations.

SPECIFIC RULES FOR STUDENTS

A Student is considered to be a person who, once the registration requirements have been formalised, has received confirmation of admission for the respective training action and has access (password) to the Moodle Virtual Educational Platform. This will be taken into consideration during the period determined by the maximum term of the training action.

1. Admission and matriculation

a. Those interested will be admitted who create the user and make the payment of the registration of the course.
b. In all cases, the Teacher reserves the right of admission.
c. The Student will receive in his/her mail the confirmation of his/her registration in the course and from that moment he/she will be able to access to the Course of Ocular Prostheses.Serán admitidos aquellos interesados que creen el usuario y realicen el pago de la matrícula del curso.

2. Economic requirements

  1. To make the total payment of the training activity in advance, according to the respective indications.

3. Access to the Virtual Platform

a. It is the responsibility of the Student to have been informed about the functioning and the way of interacting on the Virtual Platform.
b. The user password enables the Student to access the Virtual Platform up to the maximum term of completion foreseen for the training action in which he/she participates. In the event of cancellation for any reason, access will be blocked.
c. The Platform does not verify the technological requirements available to the Student. The technical or operational problems of access to the training action, due to not having the minimum detailed technical requirements, are the sole responsibility of the Student.
d. For the activity on the Virtual Educational Platform, the Official Spanish Time (physical headquarters) will be used as a reference.
e. The Student undertakes to comply with the planned schedule of activities and the Teacher’s indications.

4. Study deadlines

a. Deadlines start – in any case – from the moment the Student accesses the Virtual Educational Platform for the first time. If this initial access is not registered within the first 10 days after the admission and matriculation of the Student, the same will be considered withdrawn, without the possibility of refunding the registration fees paid.
b. Two types of term are considered applicable for each Study Unit as well as for the entire course:
● Recommended term: it is the time necessary for an adequate reading and study with the best use of the teaching system.
● Maximum term: it is the time limit within which the activities foreseen in each training action must be completed.
c. The recommended and maximum term to complete the study and partial evaluation of each one of the Units of content, is the one assigned in the corresponding description of each formative action.
d. It is mandatory to complete all the Content Units, with their corresponding evaluations, within the maximum period assigned. It will not be possible to go the next Unit without having completed and passed the previous one. The authorization to access the next Unit will take place automatically or at the latest 48 hours after the Teacher has received the results of the activities and of the obligatory evaluations, unless they require a reworking by the Student, which will be informed to him/her in the same maximum term.
e. If a final work is required, it will be equivalent to one Unit.
f. Failure to comply with the stipulated maximum period will automatically result in the temporary suspension of access to the Platform, until the requirements for approval of the corresponding Unit are completed. As access is suspended, communication will be exclusively by email.
g. Cancellation of registration will require, in order to retake studies, a new application for admission with the corresponding payment of the registration fees. The Teacher may consider exceptional cases duly justified

5. Study material and methodological development

For the study of the agenda of each training action, the Virtual Platform offers different tools according to the topic and its level of complexity.
The general basic material is the following (documents in PDF format, or similar, protected):
● Required readings in PDF format
● Forums to ask questions
● Evaluations in test format
In addition, other documents and references can be recommended for free access.

6. Standards for evaluating academic performance (requirements to pass the course):

The Teacher in charge of the course will evaluate the academic performance of the Student throughout the course (continuous evaluation), according to the general and specific criteria indicated:
General criteria:
● Compliance with the recommended study and evaluation deadlines.
● Compliance with partial/final evaluations and compulsory work.
Specific criteria:
The Teacher will assign a final (overall) grade between 0 (zero) and 10 (ten), correspondingly:
● 0 to 7.9 = Suspended
● 8 to 8.9 = Notable
● 9 to 10 = Excellent

7. Accreditation (certificate)

a. The Student who completes the compulsory activities, passes the partial evaluation of the Units and, if applicable, the general evaluation and/or the final work, will obtain a Certificate accrediting the qualification obtained. The Certificate can be downloaded from the Virtual Platform.
b. Partial accreditation will not be issued for each completed Unit of Study.

8. Personalized attention

The only means of communication between Student and Teacher is the Moodle Virtual Platform (messaging service) and, for urgent cases, the registered email.
The Student has the right to receive an answer to the doubts and queries posed to the Teacher, within a reasonable period of time, provided that they are directly related to the subject matter of the course (methodology, formal aspects, study technique, content). Consultations for the resolution of cases other than those raised in the course will not be admissible.

9. Retake (repetition of the course)

In the event that the Student, having fulfilled all the requirements for access to the formative action, is unable to achieve the pre-established academic goals (achievement and performance), or requests voluntary resignation for reasons of force majeure, it is possible to offer the possibility of repeating the course without additional payment for a single time – at the sole discretion and decision of the Teacher.

10. Intellectual property

The contracting of the corresponding training action and access to it should not be interpreted as a transfer of Intellectual and/or Industrial Property Rights on the Virtual Educational Platform itself, nor on its contents, for that reason:
a. It is strictly prohibited to reproduce, in whole or in part, by any means, the contents and any of the materials presented on the Platform, except for exclusive non-commercial personal use (studio). Any use for other purposes must require prior written permission from the author (or owner of the Rights) and citing the source.
b. Trademarks and copyright© can not be copied in whole or in part and / or removed from the documents, whatever their format.
c. Any work, material or document that the Student delivers in compliance with academic or administrative requirements will maintain the Intellectual Property Rights of its author, and the Teacher may request express written authorization for its eventual publication.
d. Copying or plagiarism of activities between Students as well as directly from the Internet will be inadmissible. In case of evident similarity between works or texts sent, the Teacher may adopt the disciplinary and academic measures that he considers convenient and opportune.
e. While having access to the Virtual Educational Platform, the Student may copy all his/her personal works to any data storage medium.
f. In strict compliance with the Spanish Data Protection Law (Organic Law 15/1999, December 13th), the Organization is concerned about the correct processing and security of the data of registered users. Consequently, it is informed that the personal data will be incorporated into a file for which Francisco Llapart Castilla is responsible and owner, and that they will not be given to third parties.
g. The user expressly declares that the materials uploaded to the Virtual Platform are his/her original works. With respect to the works of third parties that he/she uses or implements in them, he/she declares that he/she carries out such acts in accordance with current legislation, without infringing the rights of such third parties. Such works are used under its sole responsibility, being exonerated the University of any responsibility in this regard.
h. Users who upload their own works and materials to the Virtual Platform enjoy the protection granted in each case by the regulations in force on Intellectual Property, being free to decide what rights, authorizations or licenses are granted to other users. They may, at any time, proceed to modify or withdraw them, with no consequences other than those academically foreseen.

11. Payments

a. The amount payable for registration fees is specified in the description of each training action.
b. All prices indicated are in Euros. The prices are tax free.
c. The indicated price does not include the costs of access and use of Internet necessary for the development of the studies.
d. The accepted means of payment are:
● Paypal
e. The payments received are non-refundable, except in the event that the training action could not be offered (partially or totally) for reasons of force majeure, making the corresponding withholdings derived from administrative expenses (5%).
